Is This Arrest Valid, Officer Sir?

First before I confuse you to the point of no return I am talking about an arrest by a police officer for an alleged crime. What I am not talking about is any other type of arrest whether it be a citizen’s arrest for loitering or a cardiac arrest after suffering a massive heart attack that involved the Left Anterior Descending Artery. I just want to make some comments that may help a reader when they are arrested in an instance where the law has either overstepped their bounds or where they are not understanding the situation that has transpired.

Most arrests where this occurs involves a group of people involved in an activity that is considered by the general public to be contrary to the greater good. Many times when an officer makes an arrest they are just going on the basis of guilt by association and this is where the problem lies. So what does the arrestee have as a course of action that is within his rights as a citizen of the United States of America? Well unfortunately very few unless they know something about due process and when that process is being handled incorrectly and therefore illegally.

The problem here is that many people don’t understand what is involved in an arrest that is carried out in a legal and forthright manner and therefore cannot question it and end up going along unnecessarily. Police officers know this and it make them relax in their duties and they do not often go through the correct process because it is a hassle and they know that if the person being arrested doesn’t know any better then nothing will come of it.

This is where the fun begins my friends because due process is not that hard to understand and know (I mean COPS learn it right? It can’t be that hard!) and therefore you can legally refuse to be arrested if there is no legal basis for arrest and can stick it to those guys who are addicted to their authority. Now this is not to say that you should go out and do questionable behaviors just to catch a cop with his head up his butt but it does come in useful from time to time.
